These Terms and Conditions ("Terms") govern your use of Location Alert, an SMS reminder service operated by Santa Martha Cafe LLC ("we," "us," or "our") through https://www.santamarthacafe.com/. By enrolling in or using Location Alert, you agree to these Terms.

1. Service Description

Location Alert lets users schedule informational SMS reminders, including location-based, personal, and medication reminders. The service sends messages according to the schedule and information supplied by the user. Location Alert does not independently confirm whether reminder information is complete, accurate, medically appropriate, or current.

2. Eligibility and Account Information

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to enroll. You agree to provide a valid mobile number that you own or are authorized to use and to keep your contact and reminder information accurate.

You may cancel SMS messages at any time by replying STOP. After you send STOP, you may receive one final message confirming your cancellation. You may also withdraw consent by contacting us using the information below. We will honor reasonable opt-out requests as required by applicable law. To receive messages again after opting out, you must enroll again.

6. Message Delivery and Carrier Terms

Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier, device, network availability, correct account information, and other factors outside our control. Location Alert may not be available through every carrier or in every location. You are responsible for charges imposed by your wireless provider.

7. Medication and Health Reminders

Location Alert is an organizational reminder tool only. It does not provide medical advice, diagnose conditions, prescribe treatment, confirm medication instructions, or replace the advice of a licensed healthcare professional. Always follow instructions from your doctor, pharmacist, or medication label. Verify every medication schedule before relying on a reminder.

Do not use Location Alert for emergencies or time-critical medical care. If you believe you are experiencing a medical emergency, call 911 or your local emergency service immediately. Do not delay care while waiting for a text message.

8. Your Responsibilities

You agree not to:

• Use the service for unlawful, fraudulent, abusive, threatening, or harmful purposes;
• Enroll a mobile number without the subscriber's permission;
• Interfere with, overload, reverse engineer, or attempt unauthorized access to the service; or
• Enter content that violates another person's rights or applicable law.

You are responsible for reviewing your reminder content, schedule, time zone, device settings, and delivery status. You should maintain another reliable method for remembering important or time-sensitive tasks.

9. Availability, Changes, and Termination

We may modify, suspend, or discontinue all or part of Location Alert when reasonably necessary, including for maintenance, security, legal compliance, or misuse. We may restrict or terminate access if these Terms are violated. We do not guarantee uninterrupted or error-free operation.

10. Disclaimer of Warranties

To the fullest extent permitted by law, Location Alert is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that every reminder will be delivered, delivered on time, or free from error. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, Santa Martha Cafe LLC and its owners, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Location Alert, including missed, delayed, incorrect, or duplicate reminders. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

12. Privacy

Our collection and use of personal information is described in the Location Alert Privacy Policy. Mobile numbers and SMS opt-in information are not sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.

13. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles, except where applicable federal law or consumer-protection law requires otherwise.

14. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised effective date. If a change materially affects the SMS program or your rights, we will provide additional notice when required by law. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.
